Terms of Service

These Terms of Service ("Terms") govern your use of eFiling Assistant ("the app"), a desktop application operated by Franz Christian Morelos (Philippines) ("we", "us"). By installing or using the app, you agree to these Terms. If you do not agree, do not use the app.

The short version: eFiling Assistant is a tool to help you prepare and send your court filings — it is not legal advice and it does not guarantee a court will accept any filing. You remain fully responsible for your filings. Use it with a licensed Google account you control.

1. What the app is

eFiling Assistant helps Philippine law offices format and electronically transmit civil-case pleadings in line with the Supreme Court's eFiling guidelines. It runs on your own computer and sends e-mail from your own Gmail account at your instruction. It is a productivity tool, not a law firm, and it does not provide legal advice.

2. License to use

We grant you a personal, non-exclusive, non-transferable, revocable license to install and use the app for your own legal practice, subject to these Terms and to your having a valid, licensed account. You may not resell, redistribute, sublicense, rent, or share your access; reverse-engineer, decompile, or tamper with the app except to the extent that right cannot be waived by law; or use the app to violate any law or the rights of others.

3. Eligibility & accounts

The app is intended for legal practitioners and their staff. You must sign in with a Google account you are authorized to use, and you should file from your professional e-mail of record. Access is tied to the e-mail address you are licensed under; we may grant, suspend, or revoke access at our discretion, including for non-payment or breach of these Terms.

The app, its prompts, checks, and templates are for convenience only and do not constitute legal advice. eFiling Assistant is an independent tool and is not affiliated with, endorsed by, or operated by the Supreme Court of the Philippines or any court or government body. The Supreme Court's official issuances govern in all cases; where the app and an official rule differ, the official rule controls.

6. Warranty disclaimer

The app is provided "as is" and "as available," without warranties of any kind, whether express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the app will be error-free or uninterrupted, that it will meet every requirement of any court, or that any filing prepared or sent with it will be accepted, received, or treated as timely by any court.

7. Limitation of liability

To the maximum extent permitted by law, we will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of data, profits, cases, deadlines, or goodwill, arising out of or relating to your use of (or inability to use) the app. Our total aggregate liability for any claim relating to the app will not exceed the amount you paid for it in the twelve (12) months before the claim.

8. Google and third-party services

The app uses Google sign-in and the Gmail API to send mail from your account. Your use of those services is also subject to Google's own terms and policies. The app's handling of Google user data is described in our Privacy Policy, which is incorporated into these Terms.

9. Payment, updates & termination

Any fees, billing terms, and refund terms are those communicated to you at purchase. The app may update itself automatically to deliver fixes and improvements. We may modify or discontinue the app, or terminate your access, at any time; you may stop using the app and uninstall it at any time. Sections that by their nature should survive termination (e.g. disclaimers and limitation of liability) survive.

10. Changes to these Terms

We may update these Terms; the "Last updated" date above will change, and material changes will be communicated to licensed users. Continued use after a change means you accept the updated Terms.

11. Governing law

These Terms are governed by the laws of the Republic of the Philippines, without regard to conflict-of-laws rules. The courts of the Philippines will have jurisdiction over any dispute, to the extent permitted by law.
